Personal Information We Collect

Private Lender Network and its representatives and agents collect personal information in a number of circumstances in the course of providing you with products and services and otherwise administering our business. We collect personal information primarily from you, for instance through loan applications, supporting information and documentation you provide. In connection with processing your loan application, we may collect personal information from references, employers and other financial institutions you have identified in your loan application as well as other third party sources. We may also collect personal information about you through your ongoing interactions with us. Personal information we collect includes:

information you provide to us on new, loan requests, account set-up screens, and other forms including your name, address, telephone number, email address, social insurance number (if provided), driver’s license or other government photo ID, information about your employment, length at address, spouse or partner’s contact information, references, salary, pay dates and other contact, financial or biographical information you provide to us;

Privacy Policy

Private Lender Network understands that your privacy is very important to you. We want every customer, associate, and vendor to know how we protect a customer’s personal information and financial privacy. This policy exists so that everyone can understand what our business practices are in relation to the personal information under Private Lender Networks’ control.

Our privacy policy applies to our collection, use and disclosure of personal information of customers in Canada. Personal information means information about an identifiable individual, as more particularly described by applicable privacy laws. This policy does not apply to information about our employees or information that is not personal information.

Your Consent

Consent to the collection, use and disclosure of personal information may be given in various ways. Consent can be express (for example, orally, electronically or on a form you may sign describing the intended uses and disclosures of personal information) or implied (for example, when you provide information necessary for a product or service you have requested). You may provide your consent in some circumstances where notice has been provided to you about our intentions with respect to your personal information and you have not withdrawn your consent for an identified purpose, such as by using an “opt out” option provided, if any. Consent may be given by your authorized representative (such as a legal guardian or a person having a power of attorney). Generally, by providing us with personal information, we will assume that you consent to our collection, use and disclosure of such information for the purposes identified or described in this privacy policy, if applicable, or otherwise at the time of collection.

You may withdraw your consent to our collection, use and disclosure of personal information at any time, subject to contractual and legal restrictions and reasonable notice. Note that if you withdraw your consent to certain uses of your personal information, we may no longer be able to provide certain of our products or services. Note also that where we have provided or are providing services to you, your consent will be valid for so long as necessary to fulfill the purposes described in this policy or otherwise at the time of collection, and you may not be permitted to withdraw consent to certain necessary uses and disclosures (for example, but not limited to, maintaining reasonable business and transaction records, disclosures to Canadian and foreign government entities as required to comply with laws, and reporting, if applicable).

Private Lender Network collects uses and discloses your personal information with your consent, except as permitted or required by law. We may be required or permitted under statute or regulation to collect, use or disclose personal information without your consent, for example to comply with a court order, to comply with local or federal regulations or a legally permitted inquiry by a government agency, or to collect a debt owed to us.

information about your transactions with us, our affiliates, or other non-affiliated third parties, including how often you visit our website, your recent transactions, size of checks, telephone requests, services purchased and other retail transaction information; information you provide to us on our website, including your name, address, email address and telephone number, to register for our website or receive marketing materials, or information you provide in an online survey; and other information we may collect with your consent or as permitted or required by law.

How We Use It

Private Lender Network uses personal information in the course of its business including for the purposes of establishing and verifying identity and the accuracy and completeness of other information provided, verifying and determining employment, references and contact information for underwriting, debt collection and fraud avoidance; responding to questions, contacting customers for the purposes of administering their account, confirming contact information and collecting debts, administering our business and maintaining records for reasonable periods, meeting legal, regulatory, insurance, security and processing requirements, preventing fraud or abuse, and otherwise with your consent or as permitted or required by law.

If you consent, we may also use your personal information to send you marketing materials or other information regarding Private Lender Network products and services. We may also disclose your personal information to affiliates with whom we have a joint marketing agreement, and with unaffiliated third parties who license Private Lender Network software, so that they may send you information about their own products and services. Who We Share It With

Private Lender Network may disclose personal information to collect debts itself or to collect debts through collection agencies including affiliates acting in this capacity. Private Lender Network may disclose personal information to organizations who help us locate customers for debt collections purposes. Private Lender Network may also disclose personal information to financial institutions for payment processing purposes.

We may transfer personal information to outside service providers (including affiliates of Private Lender Network acting in this capacity) so that they may perform administrative, marketing or similar services on our behalf, or otherwise collect, use, disclose, store or process personal information on our behalf for the purposes described in this policy. Some of these service providers or affiliates may be located outside of Canada, including in the United States, and your personal information may be collected, used, disclosed, stored and processed in the United States or elsewhere outside of Canada for the purposes described in this policy. Reasonable contractual or other measures we may take to protect your personal information while processed or handled by these service providers are subject to legal requirements in Canada, the United States and other foreign countries applicable to our affiliates, agents and service providers, for example lawful requirements to disclose personal information to government authorities in those countries.

Private Lender Network may use personal information and disclose it to parties connected with the proposed or actual financing, legitimization, insuring, sale, assignment or other disposal of all or part of our business or assets, for the purposes of evaluating and/or performing the proposed transaction(s). These purposes may include, as examples, permitting those parties to determine whether to proceed or continue with the transaction and fulfilling reporting, inspection or audit requirements or obligations to those parties. Assignees or successors of Private Lender Network may use and disclose your personal information for similar purposes as those described in this policy.

Private Lender Network may disclose your personal information as necessary to meet legal, regulatory, insurance, audit, and security requirements, and as otherwise with your consent or as permitted or required by law (including as required by applicable Canadian and foreign laws applicable Private Lender Network or our lenders and service providers, and including lawful requirements to disclose personal information to government authorities in those countries).

Our Website

For each visitor to our website, our Web server automatically recognizes and collects certain technical information about their visit, including the domain name from which information was requested and aggregate information on what web pages were accessed or visited. We use this information to improve the content of our website and to customize the content and/or layout of our pages for each individual visitor.

With respect to cookies: We use cookies to store visitors preferences, record user-specific information on what web pages users access or visit, and alert visitors to new areas that we think might be of interest to them when they return to our site. If you do not wish to receive cookies you may be able to configure your browser not to accept cookies or to notify you if a cookie is sent to you. If you decline cookies you may not be able to use all the features of our website.

Security

Private Lender Network takes reasonable steps to protect your personal information using physical, electronic or procedural security measures appropriate to the sensitivity of the information in our custody or control, which may include safeguards to protect against loss or theft, as well as unauthorized access, disclosure, copying, use or modification. Authorized employees and agents of Private Lender Network who require access to your personal information in order to full-fill their job requirements will have access to your personal information.

Access and Correction of Your Personal Information

If you wish to request access or correction of your personal information in our custody or control, you may write to us at the contact information provided above. Your right to access or correct your personal information is subject to applicable legal restrictions. We may take reasonable steps to verify your identity before granting access or making corrections.

Privacy Policy Changes

This privacy policy may be revised from time to time. If we intend to use or disclose personal information for purposes materially different than those described in this policy, we will make reasonable efforts to notify affected individuals, if necessary, including by revising this policy. If you are concerned about how your personal information is used, you should contact us as described above or visit this website to obtain a current copy of this policy. We urge you to request and review this policy frequently to obtain the current version. Your continued provision of personal information or use of our services following any changes to this policy constitutes your acceptance of any such changes. This policy is effective as of April 1, 2015.

Pre-Authorized Agreement

WHEREAS the undersigned (“I, My or Me) as used herein refer to (CUSTOMER NAME) and the words “we,” “our,” “us,” and mean. EFT Canada Inc. (Payee) has been contracted by 7940696 Canada Inc. (Entity providing the Payor Goods and Services). You the payor, authorize EFT Canada Inc. (Payee) to debit the bank account identified in this form. AND WHEREAS I hereby to grant 7940696 Canada Inc. (hereinafter referred to as “7940696 Canada Inc..“) access to my bank account for the purpose of allowing “7940696 Canada Inc.” to debit such account for amounts owing by Me pursuant to this Pre-Authorized Agreement.
NOW, THEREFORE, We hereby authorize and agree as follows:

  1. Scope – I acknowledge that this Authorization is provided for the benefit of “7940696 Canada Inc.“ and my financial institution named on my application form (Financial Institution) and is provided in consideration of the Financial Institution agreeing to process debits against My account (Account) in accordance with the Rules of the Canadian Payment Association.
  2. Authority to Debit Account –  I understand that the transaction amount may increase or decrease from time to time because We choose to change the status or nature of My requested services.  I hereby authorize “7940696 Canada Inc.“ to draw on the Account for the purpose of paying “7940696 Canada Inc.” amounts owing to it pursuant to the Customer and PAD agreement(s).
  3. Cancellation of Arrangement – This PAD Authorization may be cancelled upon notice by Me.  I acknowledge that, in order to revoke this Authorization,  I must provide notice in writing to “7940696 Canada Inc.“.  I acknowledge that it could take up to 10 business days after “7940696 Canada Inc.“ receipt of such notice to implement My revocation.
  4. Waiver of Pre-notification –  I and “7940696 Canada Inc.“ agree to waive the pre-notification requirement, as set out in Section 7 of Appendix II of rule H4 of the Canadian Payments Association, of any debit to My Account.
  5. Validation by Processing Institution – I acknowledge and authorize the Financial Institution to (i) verify that a PAD has been issued in accordance with the particulars of this Authorization including, but not limited to, the amount; (ii) verify that any purpose of payment for which the PAD was issued has been fulfilled by “7940696 Canada Inc.” as a condition to honoring a PAD issued on My Account.
  6. My Rights of Dispute – A PAD may be disputed by Me under the following conditions:
    (i) the PAD was not drawn in accordance with My Authorization; or (ii) the Authorization was revoked.
    In order to be reimbursed. I acknowledge that a declaration to the effect that either (i) or (ii) took place, must be completed and presented to the branch of the Financial Institution holding My Account up to and including 10 business days after the date on which the PAD in dispute was posted to My Account.
    I acknowledge that a claim on the basis that My Authorization was revoked, or any other reason, is a matter to be resolved solely between “7940696 Canada Inc.” and I when disputing any PAD after 10 business days.
  7. Disclosure of Information Consent – I consent to the disclosure of any personal information that may be contained on this Authorization to the financial institution and/or financial services partner at which “7940696 Canada Inc.“ maintains its accounts to be credited with the PADs as far as any such disclosure of personal information is directly related to and necessary for the proper application of rule H4 of the Canadian Payments Association.

Service Fees

Our service is to introduce you to qualified lenders. For this we charge a fee. Fees for this service vary for the amount of the loan and the length for which you require it. After filling out and e-signing our secure application form, your request will be promptly presented to our “qualified private lenders”.

Please carefully review any loan offer you receive, including its terms, and rates. Then if you are satisfied with your loan offer you may proceed with the lender by accepting that offer. There is no obligation to accept the loan presented to you, and you can feel comfortable exiting the process at any time if you are not satisfied with your loan offer.  You can also contact us by filling out our online contact form and we will present your application to another lender immediately.

The terms offered to our clients may be  up to a maximum term of (5) five years. However it is at the lenders’ discretion to determine the duration of the loan term. It may be more helpful to focus on the amount you pay back in total rather than on APR alone. Loans provided by lenders can be less expensive than overdraft charges and late payment costs in most cases. When used in the right way short term loans can save borrowers money.

7940696 Canada Inc. is not a lender and does not give loans or make lending decisions. 7940696 Canada Inc. only provides an introductory service for private lenders, and does not represent any loan provider or single lending service. 7940696 Canada Inc. does charge a non-refundable Application and Subscription Fee of One Hundred And Twenty Six Dollars & Ninety Nine Cents ($126.99)  together with HST for a total of One Hundred Forty Five Dollars and Ninety Nine cents ($145.99) that will be deducted from your bank account within the next (30) thirty days after submitting our secure application form for access to our qualified lenders. 7940696 Canada Inc. does not guarantee the applicant a loan product because that decisions is based on the lender’s discretion. Refund Policy

The extent of your liability for an unauthorized transaction may be determined by your promptness in notifying us if a withdrawal shown in your bank account is incorrect or unauthorized. Failure to notify us immediately if an error has occurred may waive our liability for or ability to correct such errors.

If you believe there has been an error or unauthorized transaction, contact us by email or through our website as soon as possible. We will advise you of the results of our investigation within 10 business days of hearing from you, and if we have made an error, we will correct it promptly and at no cost to you, provided such error was brought to our attention on an immediate basis. We will reimburse you for any NSF or other charges that your bank may have charged you as a result of an unauthorized transaction or a transaction sent in error by us upon completion of our investigation. Your account will also be credited any fees that we may have collected from you in error.

Please note there are no refunds for using our service. Once you submit an application through our website we promptly send your request to our private lenders, and we take the position that we have earned our fee. In the event that your payment is returned NSF we will charge your bank account Thirty Five ($35). Accordingly, it is our position that there can be no refund in situations where our services were rendered as offered by 7940696 Canada Inc..
